Privacy policy
Applicable Costa Rican law and responsible party
This policy is intended to describe the processing carried out through this website under Costa Rican Law No. 8968, Protection of the Person against the Processing of Personal Data, and Executive Decree No. 37554-JP, its regulation, as amended by Executive Decrees No. 40008-JP and No. 41582, as applicable.
For the data collected through this website, Law Firm VS is the responsible party for the database and processing described here. Contact details are info@bufetevs.com, +506 8885 6819, and Creole Building, Tibás, next to La Nación, San José, 10111.
Personal data we receive
We receive the personal data that a person freely submits through the contact form or another published contact channel. The contact form requests the following information:
- Name, so we can identify and address the person making the inquiry.
- Email address, so we can respond and continue the requested communication.
- Phone number, so we can contact the person when that channel is appropriate.
- Message content, including the information the person chooses to provide about the matter.
Technical and security data
The website and its providers may process technical information such as IP address, browser and device information, request details, session identifiers, and security-verification information. This information is used only as reasonably necessary to deliver the website, maintain session and form security, prevent abuse, investigate incidents, and keep the services working.
Cloudflare Turnstile is loaded on the contact form to distinguish legitimate requests from automated abuse. Turnstile may process technical information under Cloudflare terms and privacy practices. The office map may request map tiles from OpenStreetMap providers when the map is displayed.
Purpose of processing
We process contact data to receive and answer inquiries, understand the general subject identified by the person, coordinate a possible initial communication, provide information requested through the website, and determine whether a later professional conversation is appropriate.
We also process data to operate, secure, maintain, troubleshoot, and improve this website; respond to lawful requests from competent authorities; establish, exercise, or defend rights; and comply with obligations imposed by Costa Rican law.
We do not use contact-form data for unsolicited marketing, automated profiling, or automated decisions about a person. A message does not create an attorney-client relationship or guarantee that Law Firm VS will accept the matter.
Consent and information provided to the person
Before submitting the contact form, the person must confirm that they have read this Privacy Policy and expressly authorize the collection and use of the submitted personal data for the purposes described here. The authorization must be free, specific, informed, and unequivocal, as required by Costa Rican personal-data rules.
The information requested by the form is necessary to evaluate and answer the inquiry. If it is not provided, Law Firm VS may be unable to respond through the requested channel. A person should not submit personal data about another person unless the person has authority or another lawful basis to communicate it.
Consent may be withdrawn for future processing by contacting Law Firm VS. Withdrawal does not affect processing already carried out lawfully or processing that remains authorized or required by Costa Rican law.
Sensitive and confidential information
The public contact form is not intended for urgent, privileged, or highly sensitive information. In particular, do not submit unnecessary information about health, political opinions, religious beliefs, ethnic origin, sexual life, criminal records, children, financial accounts, identity documents, or another person.
If a person voluntarily includes sensitive or confidential information, Law Firm VS will handle it only to the extent necessary for the stated communication and applicable professional, legal, and security obligations. Sending information through the website does not by itself create professional secrecy or an attorney-client relationship.
Recipients and service providers
Access is limited to Law Firm VS personnel and service providers who need the information to respond to the inquiry, host and maintain the website, deliver email, provide security verification, or operate the map and related technical services. They may process data only for the relevant service and under confidentiality and security obligations appropriate to their role.
We do not sell personal data or disclose it for commercial distribution. Data may be disclosed when required by a competent Costa Rican authority, necessary to protect rights or security, or permitted by the Law No. 8968 and other applicable Costa Rican law.
Some technical providers may process information from locations outside Costa Rica. Where that occurs, the processing is limited to the service purpose and subject to the contractual, organizational, and technical measures used by Law Firm VS and the provider under applicable requirements.
Data quality, security, and confidentiality
People should provide accurate, current, adequate, and relevant information and should notify Law Firm VS when it needs correction or updating. We do not request more information than is reasonably necessary for the purposes described in this policy.
Law Firm VS applies reasonable administrative, technical, and organizational measures to protect personal data against unauthorized access, alteration, loss, disclosure, or misuse. Access is limited according to need, and persons who access the data must maintain confidentiality when required by their duties.
No website or transmission can be guaranteed to be completely secure. People should use the published secure channels and avoid sending information that is not necessary to receive an initial response.
Retention
We retain personal data only for the time reasonably necessary to respond to the inquiry, maintain the related communication, operate and secure the website, comply with applicable legal or professional obligations, resolve disputes, and protect or exercise rights. When it is no longer necessary, the data is deleted, anonymized, or securely disposed of according to the applicable process.
The retention period may vary according to the nature of the inquiry, whether a professional relationship is later established, legal or professional duties, and the need to preserve evidence of a communication or security event.
Rights and requests
Under Costa Rican personal-data law, a person may request access to personal data held about them and information about its purpose and use. The person may also request correction, updating, inclusion, deletion, or removal when data is inaccurate, incomplete, unnecessary, excessive, unlawfully processed, or no longer justified, subject to lawful exceptions and obligations.
To submit a request, email info@bufetevs.com with the subject "Personal data request" and identify the requester, describe the request clearly, identify the data or communication involved, and provide a safe way to receive the response. Law Firm VS may request reasonable information to verify identity and prevent disclosure to an unauthorized person.
Requests will be handled within the periods and procedures established by Costa Rican law. If a person believes their rights have been affected, they may use the complaint and protection procedures available before the Agencia de Proteccion de Datos de los Habitantes (PRODHAB), without prejudice to other rights available under Costa Rican law.
Changes and contact
This policy may be updated when the website, processing activities, service providers, or applicable Costa Rican rules change. The current version is the version published on this page.
